Helpline Calls and Incident Reports

A survey was fielded in April 2014 to determine if reports to helplines were increasing. A 2011 survey by the Society of Corporate Compliance and Ethics (SCCE) and the Health Care Compliance Association (HCCA) demonstrated that 90% of compliance professionals surveyed reported that their employer had a helpline, and that was true of 99% of publicly traded companies. The question now was whether the increased attention paid to whistleblowing had led to increased reporting of incidents.

The Relationship between the Board of Directors and the Compliance and Ethics Officer

For a compliance program to be deemed "effective" under the Sentencing Guidelines the organization’s governing authority must "…exercise reasonable oversight with respect to the implementation and effectiveness of the compliance and ethics program." Yet, while many other aspects of the Guidelines have grown well established, the relationship with the board of directors is still far from mature. Should Compliance Report to the General Counsel?

Despite past research indicating high levels of satisfaction with working with legal, compliance professionals were overwhelmingly opposed to having compliance report to legal. Of the more than 800 responses, 88% are opposed to the corporate counsel serving as the compliance officer, and 80% oppose having compliance report to the corporate counsel’s office.

The data is aggregated to help individuals and organizations compare their own data to the results of similar operations. The report breaks down the data by: all survey respondents, type, size and annual revenue of the organization, number of years the chief compliance officer has managed the compliance department and the annual compliance budget managed by the chief compliance officer, among others.

Gifts & Entertainment Policies 2012

During February and March of 2009 the Society of Corporate Compliance and Ethics (SCCE) and the Health Care Compliance Association (HCCA) jointly fielded a survey among the compliance community. The goal was to determine the level of acceptable business entertainment and gift giving. The 2009 survey revealed that, on the whole, business is fairly restrictive of the gifts employees can give and receive, as well as how they can entertain. About two-thirds (63%) either ban gifts to employees or require that they be modest or at a price less than $50. To determine if gift-giving and entertainment policies had changed in the intervening three years, SCCE and HCCA fielded the research again in June 2012. The results showed a surprisingly unchanged picture, despite increased scrutiny of corporate behavior, Dodd-Frank, the UK Bribery Act, and ongoing FCPA enforcement. Most organizations have restrictive policies, with healthcare leading the way. In addition, non-profits were generally more restrictive than for profits, and publicly traded companies, interestingly, had the least restrictive policies.
